The Kano State High Court presided over by Justice Sanusi Ado Ma’aji, has restrained the Chairman of Sumaila Local Government Council and all his Legislative Members from performing any legislative function, pending the hearing and determination of motion on notice filed by the plaintiff/applicant in the suit.
Recall that the secretary to the Sumaila LG, Dalha Alfindi alongside the entire 11 councillors of the local government recently dumped the ruling All Progressives Congress for New Nigerian People’s Party.

The court granted the application upon an ex parte application by All Progressive Congress through its Kano State Legal Adviser, Barrister Abdul Adamu Fagge.
According to copy of the Court Order, dated 11th January, 2023, the court upheld that “Upon reading the Motion Exparte together with the 9 paragraphs affidavit in support, duly sworn to by one Shehu Sa,ad Sumaila, of Kofar Arewa Quarters, Sumaila Local Government Area of Kano State dated 10th day January, 2023 and the written address filed by the Applicant Counsel dated same date,”

The presiding Judge, also ordered that the hearing notice be served to respondents from 5th to 15th with the Originating summon as well as all other subsequent court processes that may be filled or issued in the suit.
The Court further ordered that hearing notice be served on the respondents through substituted means by serving them through the office of the secretary of Sumaila Local Government Council, Kano State.
The 15 defendants in the suit include: Kano State Independent Electoral Commission, Attorney General of Kano State, Commission for Local Government and Chieftancy Affairs, Kano State and Chairman, Sumaila Local Government Council.

Others are: Mustapha Garba Haladu, Umar Ibrahim Umar, Nuhu Ado, Abubakar Ahmad, Isma’il Sabiu Salisu and other Legislative Council Members of Sumaila LGA.
The court adjourned the case till 25 January 2023 for the hearing of Originating Summons and Motion on Notice.
