Kano Chief judge shuns assembly’s invitation over Muhuyi Magaji’s probe

The Kano state Chief Judge, Justice Nura Sagir Umar has shunned an invitation extended to him by the Kano State House of Assembly to appear before its Ad-hoc Committee investigating the suspended Chairman of the State Public Complaints and Anti-Corruption Commission, Barrister Muhuyi Magaji Rimingado.

Daily Telescope gathered that the invitation letter to the Chief Judge, Justice Nura Sagir Umar was dated July 26th and signed by Barrister Nasidi, the CJ was expected to appear before the committee on Wednesday July 28.

However, the CJ neither honor the invitation nor did he reply to the Assembly.

Confirming the development to Daily Telescope, the Spokesman of Kano State Judiciary, Malam Baba Jibo Ibrahim, said the house has invited the chief judge of the state to appear before a committee.

“But for goodness sake, how can a committee of the assembly invite the CJ? for what? Is it an administrative or judicial issue?

“Even if it is judicial issue, the assembly does not have constitutional right to invite any judge on any issue talk less of the CJ. Also, if the issue is administrative, the assembly is supposed to invite the Chief Registrar, but CJ,” Ibrahim said.

The Chairman of the Nigerian Bar Association (NBA) Kano state chapter, Barrister Aminu Sani Gadanya faulted the assembly over the invitation, affirming that the legislators have no constitutional right to invite the CJ.

“It is absurd and unheard of in the law for an Ad-hoc committee of the assembly to invite the CJ. If the assembly is not comfortable over a matter or an order against it, the best thing to do is to apply to set it aside or appeal the order.

“They have no right to invite even a judge in the state over any matter, not to talk of the whole CJ. We have three arms of government, that is the Legislative, Executive and Judiciary and they all independent.

“The CJ is the head of the judiciary and the judiciary is independent. So, it is wrong for the assembly to invite CJ over an order or a matter that affect them because they are an interested party.

“Are they trying to intimidate the umpire; the judiciary or what? I am sure it was done in error as I know for sure that the Speaker will not support this act.

“I am even surprise that the letter inviting the CJ was signed by a Lawyer and a member of the NBA.’’

It could be recalled that the state’s Governor, Dr Abdullahi Umar Ganduje is making frantic efforts through Kano State House of Assembly to strip Barrister Rimingado of his position as chairman of the state anti-corruption agency.

Daily Telescope reports that Rimingado was suspended on July 5th by the assembly over a petition against him by the state Accountant General on the rejection of a chief accountant posted to his commission.

Also, on July 12 invited the assembly invited Rimingado to appear before its ad-hoc committee investigating the issue on July 14.

However, Barrister, U.U. Fari, counsel to Rimingado, on July 14 approached the assembly with a medical report informing it that his client was sick, hence could be able to appear before the committee.

He, rather requested for a certified true copy of the petition against his client, certified true copy of the assembly resolution on July 5th and a certified copy of the press releases, the assembly issued on the suspension of his client.

On July 22, the National Hospital Abuja wrote a letter to the state assembly dated July 19 replying the house letter on the medical report submitted by Rimingado, stating that the medical report is not authentic.

Furthermore, a Kano State High Court presided by Justice Sanusi Ado Ma’aji issued an order on July 23rd restraining the assembly from investigating the suspended chairman.

However, despite the order the assembly on Monday, July 26th proceeded with the matter and made five resolutions among which was a recommendation to the governor to sack the suspended anti-corruption boss.

Also, the assembly recommended to the police commissioner to arrest and prosecute Rimingado for presenting alleged fake medical report to its ad-hoc committee.

Rimingado was invited by the police, but released after he was grilled for about four hours at the Police Command Bompai.
