A Jigawa State High Court presided over by Justice M. A Sambo has discharged and acquitted a father and son, Mohammed Sani and Yahaya Sani, who were arraigned for alleged culpable homicide.
The defendants were arraigned for two-count charge of criminal conspiracy and culpable homicide contrary to sections 96 and 221 of the Jigawa panel code.
They were accused of killing one Saleh Ado of Zuge Village in Gumel Local Government of the state by hacking him an Axe.
However, the court heard that, the deceased, a lunatic, was confirmed to have sneaked into the house of the defendants with a stick and knife and attacked the first defendant (father), while the second defendant (son), while trying to defend his father uses an axe to hit the deceased (attacker), thereby resulted to his death.
The Prosecution called eight witnesses and tendered confessional statements and medical evidence, while the defense called only the second defendant and closed the case.
The Justice Sambo in his judgment, discharged and acquitted the defendants on the ground of self-defense.
